1. Purpose

These General Terms and Conditions of Sale and Use (GTCU) define the terms under which VoiceHire, a French SAS with a share capital of €20,000, headquartered at 60 rue François 1er – 75008 Paris – France, registered with the Paris Trade and Companies Register under number 933 660 003, provides its clients (hereinafter “the Client”) with artificial intelligence tools applied to human resources, in particular the execution of phone screening interviews for candidates (hereinafter “the Services”).

2. Acceptance of the GTCU

Any order, subscription, or use of the Services — including demonstration or trial versions — implies full and unconditional acceptance of these GTCU. The Client acknowledges having read, understood, and accepted all terms.

3. Orders / Subscriptions

  • Order / Subscription process: Orders and subscriptions are placed via the VoiceHire.io website.
  • Accuracy of information: The Client agrees to provide accurate and complete information when creating their account and placing an order. They also agree to keep this information up to date throughout their relationship with VoiceHire.
  • Confirmation: Order confirmation constitutes full and unconditional acceptance of these GTCU.

4. Pricing and Payment Terms

  • Pricing: Service prices are listed in euros and are exclusive of taxes (excl. VAT). Applicable taxes (including VAT) are automatically added to the invoiced amount at the time of billing.
  • Payment terms: Payment is made according to the terms specified at the time of the order (one-time payment, monthly/annual subscription, etc.).
  • Late payment: In the event of late payment, VoiceHire.io reserves the right to apply penalties in accordance with applicable law, including a fixed recovery fee of €40 and late interest equal to three times the legal interest rate in effect.
  • Subscription plans: The Client selects the subscription plan best suited to their needs. Each plan includes a monthly quota of phone screening interviews. Unused interviews for a given month (M) cannot be carried over to the following month (M+1). The Client may request a plan change at any time, which will take effect the following month.

5. Services and Terms of Execution

  • Commitment: VoiceHire undertakes to provide the Services in accordance with their description on the VoiceHire.io website, and to implement appropriate measures to ensure the proper functioning of the Services.
  • Conditions of execution: The provision of the Services is subject to the Client’s compliance with their contractual obligations.
  • Service interruption: In the event of a service disruption, VoiceHire.io will make every effort to restore the situation as quickly as possible.

6. User Responsibility / Exclusions

  • Personal use: The Client is solely responsible for their use of the Services and agrees not to infringe upon the rights of third parties or damage the image of VoiceHire.
  • Confidentiality of login credentials: It is the Client’s responsibility to maintain the confidentiality of their login credentials and password.
  • Exclusions: The Client confirms that they will not use VoiceHire’s Services for recruitment related to illegal activities or any purpose that could harm VoiceHire’s reputation.

7. Intellectual Property

  • Ownership: All elements (software, databases, content, etc.) comprising the Services are protected by intellectual property rights and remain the exclusive property of VoiceHire or its partners.
  • Prohibition of reproduction: Any reproduction or use of these elements without written authorization is strictly prohibited.

8. Liability

  • Best-effort obligation: VoiceHire commits to using all reasonable means to ensure the quality and continuity of the Services.
  • Limitation: VoiceHire’s liability may only be engaged in the event of proven fault and is limited to the amount of the relevant order or subscription.
  • Force majeure: VoiceHire shall not be held liable for any interruptions or malfunctions resulting from events of force majeure.

9. Confidentiality

  • Mutual obligation: Both parties agree to keep confidential all information exchanged within the framework of the contract.
  • Duration: This obligation remains in effect for the entire duration of the contract and after its termination.
  • Data ownership: The Client remains the sole owner and controller of the data uploaded and managed within the Services. VoiceHire holds no rights over the Client’s data.

10. Personal Data

  • Collection and processing: The personal data collected is processed in accordance with the General Data Protection Regulation (GDPR) and French legislation.
  • User rights: The User has the right to access, rectify, and delete their data by contacting the dedicated service available via the VoiceHire.io website.
  • Security: VoiceHire commits to implementing appropriate security measures to protect personal data.

11. Duration and Termination

  • Duration: The contract is concluded for the duration specified at the time of the order.
  • Termination by the Client: The Client may terminate the contract in accordance with the terms set out in the subscribed offer (notice period, early termination, etc.).
  • Termination for breach: In the event of a serious breach of contractual obligations, VoiceHire may terminate the contract automatically, without compensation.

12. Applicable Law and Jurisdiction

  • Governing law: These GTCU are governed by French law.
  • Jurisdiction: In the event of a dispute, the competent courts shall be those of VoiceHire’s registered office, unless otherwise provided by mandatory legal provisions.

13. Changes to the GTCU

  • Revision: VoiceHire reserves the right to modify these GTCU at any time.
  • Publication / Effective date: Changes will take effect automatically 15 days after notification is sent by email. In case of disagreement with the new GTCU, the Client may choose to terminate the contract at the end of their current commitment period.
